Freeze on Economic Land Concessions Must Now Be Followed by Positive Action and Existing Concessions Must Be Reviewed

The Cambodian Human Rights and Development Association (ADHOC) welcomes the announcement by Prime Minister Hun Sen that there will be a moratorium on the granting of Economic Land Concessions (ELCs). In an order dated 7 May 2012, the Prime Minister called on public authorities to “temporarily postpone” the granting of ELCs to private companies. Civil society organizations and international human rights bodies have been asking the Cambodian authorities for several years to stop granting new land concessions, to review existing ones, and to ensure respect for relevant laws and regulations, including the 2001 Land Law, Sub-Decree 146 on Economic Land Concessions, and various human rights standards. ADHOC hopes that this move by the government indicates that the demands of NGOs and human rights professionals are finally being met.

The Cambodian Human Rights and Development Association (ADHOC) strongly condemns the killing of Mr. Chut Wutty, President of Cambodia’s Natural Resources Conservation Group, on 26th April 2012. ADHOC also expresses deep concern about the lack of thorough investigation by the authorities into the case, demonstrating an apparent lack of impetus towards seeking justice. The Chief Prosecutor has refused to meet with ADHOC investigators and to make further inquiries into this case, and the police report is seen as highly contentious by NGOs and the family of the victim. Cambodian Authorities Must Investigate Killing of Chhut Vuthy and Arrest Perpetrators

The Cambodian Human Rights and Development Association (ADHOC) strongly condemns the killing of Mr. Chhut Vuthy, President of Cambodia’s Natural Resources Conservation Group and a well-known environmental activist. Mr. Chhut was killed today as he was investigating a case of illegal logging in Koh Kong province. ADHOC urges the Cambodian authorities to immediately launch an investigation into his death and arrest perpetrators.

It is pleasure for me to welcome you today to this very important event on human rights and democracy organised by Adhoc with the support of the European Union. This event is important not only because of the upcoming commune council elections scheduled for 03 June 2012 but also because democracy is more than about elections. Democracy is an every day challenge, democracy is about constant interaction between the different stakeholders of any society. Democracy is about confronting ideas and constructive dialogue. It is why today we have members of the National Assembly, Senate, political parties, and members of local authorities present to discuss with the Civil Society their contribution to democracy and the promotion human rights.

The Delegation of European Union to Cambodia has worked closely with our NGO partner, Adhoc, to organise this event. In collaboration with the Royal Government of Cambodia and civil society partners the EU has regularly supported similar events over the last years as part of our contribution to Cambodia’s efforts to build a democratic society. And we will continue to do so ! Partnership, constructive dialogue and mutual respect between key actors – Government, Political Parties and Civil Society

The Cambodian Human Rights and Development Association (ADHOC) is deeply concerned about illegitimate restrictions to the right to freedom of expression and illegal arrests of community representatives in relation to the ASEAN People’s Forum, happened last weekend in Phnom Penh. On 31 March 2012, two community leaders were prevented from participating in a workshop of the ASEAN Civil Society Conference/ASEAN Peoples’ Forum (ACSC/APF) and detained by the police without any legal justification.

We, more than 1,200 delegates from all ten ASEAN countries representing various civil society organizations and movements of workers from rural and urban sectors as well as the migrant sector, peasants and farmers, women, children, youth, the elderly, persons with disabilities, urban poor, Indigenous Peoples, victims of human rights violations, domestic workers, lesbian gay transgender/transsexual intersex and queer (LGBTIQ) people, human rights defenders and other groups, gathered together in Phnom Penh for the 2012 ASEAN Civil Society Conference / Peoples’ Forum (ACSC/APF) on 29-31 March 2012, to discuss issues under the theme “Transforming ASEAN into a People Centered Community”.

The growing awareness of ASEAN and its meetings and institutions by the region’s people is encouraging. However, we note with deep disappointment that during the ACSC/APF unacceptable restrictions were imposed on participants’ human rights to freedom of expression and assembly. Certain participants were continuously discouraged from attending the ACSC/APF, and workshops on land rights and on Burma/Myanmar were not allowed to take place.

ឆ្នាំ ២០១១ ជាឆ្នាំដែលមានការផ្តល់សម្បទានដីសេដ្ឋកិច្ច ជាច្រើនរហូតដល់កាត់ដី ចេញពីឧទ្យានជាតិ ពីតំបន់ ការពារសត្វនិងរុក្ខជាតិ តាមរយៈការធ្វើអនុប្បយោគ ពីដីកម្មសិទ្ធិ សាធារណៈរបស់រដ្ឋ មកជាដីកម្មសិទ្ធិឯកជន របស់រដ្ឋ។ ក្នុងឆ្នាំ ២០១១ នេះ រាជរដ្ឋាភិបាល បានចេញ អនុក្រឹត្យចំនួន ១២៣ អនុក្រឹត្យ ដើម្បីផ្តល់ សម្បទានដីសេដ្ឋកិច្ច ទៅអោយក្រុមហ៊ុនឯកជន ដែលមានផ្ទៃដីចំនួន ៧៥១,៨៨២ ហិកតា។

ក្នុងចំនួន នេះ ផ្ទៃដីជាង ២/៣ បានកាត់ចេញពី ដីការពារដោយ ព្រះរាជក្រឹត្យ ហើយមានដីតែ ២១៩,៤២៥ ហិកតា ប៉ុណ្ណោះ ដែលមិនប៉ះពាល់ ដីការពារដោយព្រះរាជក្រឹត្យ។ តួលេខនេះបញ្ជាក់ អោយឃើញ ច្បាស់ថា នៅប្រទេសកម្ពុជា ពុំមានដីទំនេរ ច្រើនទៀតទេ សំរាប់ផ្តល់ សម្បទានដីសេដ្ឋកិច្ច ដល់ក្រុមហ៊ុនឯកជន។ ការផ្តល់ សម្បទានដីសេដ្ឋកិច្ច ដ៏ច្រើននេះ ក៏ជាមូលហេតុដ៏ចម្បងផងដែរ ដែលបង្កអោយមាន ទំនាស់ដីធ្លី នាពេលបច្ចុប្បន្ន និងទៅបណ្តា ឆ្នាំខាងមុខៗ ទៀត។

Two Human Rights Defenders Arrested as They Were Assisting Citizens to File a Petition against Land Rights Violations

Cambodian Authorities Must Immediately Arrest Former Bavet City Governor Chhuk Bundith

Although former Bavet City Governor Chhuk Bundith confessed that he was the gunman who shot three female workers on 20 February during a protest at Svay Rieng Special Economic Zone (SEZ), Provincial Prosecutor Hing Bunchea allowed him to go free after questioning yesterday. Given the seriousness of the crime and the risks of interference with the victims and witnesses, Cambodian authorities must immediately arrest Chhuk Bundith and place him in detention while investigating the case.
